EXECUTIVE ORDER ESTABLISHING THE GOVERNOR'S
INTERAGENCY REVENUE SHARING NEGOTIATION TASK FORCE
Whereas, current agreements between the State and Tribes concerning revenue sharing impact the State of Montana budget and other important agreements; and
Whereas the State of Montana is committed to improving the economic conditions on its seven Indian reservations and throughout Montana; and to these ends may negotiate state tribal revenue sharing agreements;
NOW THEREFORE, I, Brian Schweitzer, by virtue of the power vested in me as Governor of the State of Montana, do hereby establish an Interagency Revenue Sharing Negotiation Task Force.
I. PURPOSE: The Interagency Revenue Sharing Negotiation Task Force shall:
a.) Provide a forum for discussing all current and any proposed new or modified Tribal Revenue Sharing Agreements before any new proposals or modifications are entered with the Tribal Nations.
b.) The Task Force shall work with and report to the Governor's Office on any newly proposed Tribal Revenue Sharing Agreements or modifications to current agreements, or urgent precedent setting issues before any new agreements are entered into or modifications are adopted.
II. COMPOSITION:
The Interagency Revenue Sharing Negotiation Task Force shall consist of representatives appointed by the Governor from the appropriate agencies; the Governor's Office of Budget and Program Planning, and a lead attorney, independent of the government agencies who can examine the tax issues that arise. The Task Force is authorized to contract with legal counsel for their services. Not all Task Force meetings will be pertinent to all agency representatives, but the representative of an agency impacted by an agreement scheduled for discussion or who will administer the agreement must have their representative present.
The Governor's Budget Director shall be the Chair of the Task Force. All members of the Task Force, including the Chair, serve at the pleasure of the Governor and may be removed at any time. Three members constitute a quorum of the Task Force.
The Task Force shall use legal assistance from the Department of Justice and protocols and relationship assistance from the Coordinator of Indian Affair's Office.
The Task Force shall meet on a regular basis as set by the Task Force in noticed meetings or as called by the Chair.
II. DURATION:
This Executive Order shall become effective upon its signing and shall remain in force and effect until amended or rescinded by further Executive Order.
